Terms of Service

1. The service

xmob.ai is a B2B growth platform. Its AI Sales Crew (Scout, Writer, Chaser, Booker and Tender Watcher, coordinated by a Crew Lead) researches prospects, drafts outreach, follows up and proposes meetings. The crew proposes; you decide. Nothing is sent from your accounts unless you, or a person you authorise, approved it.

We may change, add or remove features. Features marked as early access or beta may be incomplete.

2. Accounts

You must give accurate information, keep your credentials secure and tell us promptly about any unauthorised use. You are responsible for what happens under your account and for the people you invite to your workspace.

3. Your responsibilities for outreach

You are the sender of any message sent from your mailbox. You are responsible for:

• having a lawful basis to contact each recipient under the laws that apply to you and to them, including email-marketing, data-protection and consumer rules in the countries you target;
• honouring opt-outs. xmob.ai stops all contact with an address that has opted out; you must not try to get around that;
• the accuracy of what your messages say about your company, products and prices;
• reviewing each draft before you approve it.

The crew applies safeguards (an opt-out line, an AI disclosure, suppression lists, country rules, sending limits). They help; they do not replace your own compliance, and we do not give legal advice.

4. AI output

AI-generated research and drafts can be wrong or incomplete. We design the crew so that every factual claim in outreach points to a source you gave it, but you must check drafts before approving them. We do not guarantee any result, such as replies, meetings or sales.

5. Connected accounts

When you connect a Google or Microsoft mailbox or calendar you authorise us to use it as described in our Privacy Policy, and only for your workspace. You can disconnect at any time. You must comply with the terms of the provider of any account you connect. Our use of information received from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements.

6. Plans and payment

Paid plans, their limits and prices are shown on our pricing page when you subscribe. Payments are processed by Stripe. Subscriptions renew until you cancel; cancelling takes effect at the end of the paid period. Prices exclude taxes unless stated. Fees already paid are non-refundable except where the law says otherwise or we state it at purchase.

7. Acceptable use

You will not use the service to:

• send unlawful, deceptive, harassing or unsolicited bulk messages that break the law that applies to you or the recipient;
• collect or use data you have no right to use, or contact people who have opted out;
• infringe the rights of others, spread malware, or attempt to disrupt, probe or reverse-engineer the service;
• resell or give others access to the service outside your workspace without our written consent.

We may pause sending or suspend an account that risks harm, such as a high bounce rate, complaints or a legal request.

8. Your data and our rights

You keep your rights in the content and data you put into the service. You give us a limited licence to host and process it to provide the service to you. We keep our rights in the platform, its software and its design, and in aggregated, de-identified usage information.

9. Privacy and data processing

Our Privacy Policy (https://xmob.ai/privacy) explains how we handle personal data. For contact data of your own prospects that you or the crew process in xmob.ai, you are the controller and we are your processor; a data processing agreement is available on request and forms part of these terms for customers who need one.

10. Availability and support

We work to keep the service available but do not promise uninterrupted operation. We may carry out maintenance and will try to give notice of planned downtime.

11. Ending the agreement

You can stop using the service and close your account at any time. We may suspend or end your access if you break these terms, if the law requires, or if non-payment continues after notice. On closing we handle data as described in the Privacy Policy.

12. No warranty

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose and non-infringement.

13. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law, including for intent or gross negligence, or your statutory rights as a consumer where they apply.

14. Governing law

These terms are governed by the law of the country in which Zee Design is established, subject to any mandatory rules that protect you. Disputes go to the competent courts there, unless mandatory law gives you the right to bring a claim elsewhere.

15. Changes to these terms

We may update these terms. We will tell account holders about material changes in advance. If you keep using the service after a change takes effect, you accept the new terms.
